General Terms and Conditions of Sale Bohomi - 7000 Mons, Belgium

All agreements between the buyer and the seller are governed by these terms and conditions, unless otherwise expressly agreed. Any deviation from this rule must be expressly agreed with us in writing. The application of any general conditions used by the buyer is excluded.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Bohomi.be website. These products and services are offered within the limits of available stocks. The stocks are kept up to date on a daily basis. It may happen that the number of products ordered is higher than the number of products in stock. In this case you will be notified by e-mail, and we will indicate the date of availability of your product. The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product offered, especially with regard to colors.


Offers, orders and order confirmations

Offers, in whatever form, made by the seller are only valid after express written confirmation by the seller.
The buyer, who wishes to buy a product or a service must obligatorily :

  • Fill in the identification form on which he will indicate all the details requested, as well as all the information necessary for the delivery. The password that allows access to his customer account is strictly personal. During each visit, access to personal data, or placing an order, the customer will have previously identified himself with his login and password.
  • Validate the order after having checked it.
  • To carry out the payment in the conditions envisaged..

The confirmation of an order implies the acceptance of the present conditions of sale, the recognition of having perfect knowledge of them and the renunciation to prevail itself of its own conditions of purchase or other conditions. All data provided and confirmations will be considered as proof of transaction.

The confirmation will be considered as a signature and acceptance of the operations carried out. Bohomi will communicate by e-mail the confirmation of the registered order. Bohomi cannot be held responsible for the consequences of any event beyond its control, in particular force majeure, which would tend to delay or prevent the placing of the online order. Some orders may be subject to additional requests to the customer. In this case, the customer will be informed by email or telephone of the supporting documents to be sent in order to obtain the final validation of his order.

Bohomi reserves the right to cancel the order in case of non-receipt of the supporting documents or in case of receipt of documents that are not in conformity with the order. The customer's order can be cancelled by Bohomi for any reason, especially in case of lack of information necessary for delivery. The customer will be informed by Bohomi.



All our prices are always inclusive of VAT, excluding packaging, assembly and installation costs as well as the start-up of the products. All prices and incidental costs are those valid at the time of delivery.
If, between the date of conclusion of the sales agreement and the date of delivery, the prices have increased for any reason whatsoever, the seller has the right to recover this price increase from the buyer. If the price exceeds the agreed price by 10%, the buyer has the right to withdraw from the contract.



Payment for purchases made on the website www.bohomi.be is made when the order is placed.

Payments by credit card are made through the secure system of Ogone which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it.



The customer undertakes to transmit, at the time of the order, all the information necessary for the delivery in order to guarantee the good end of it. In particular, the customer must provide a telephone number where the carrier can reach him during the day. The customer undertakes, for himself or for the recipient of the order, to take delivery of the goods at the address he indicated when ordering.

At the time of delivery, the customer or the recipient of the products, must be able, if requested, to prove his identity. The customer undertakes, after opening and checking the contents of the package(s) in the presence of the carrier, to sign the delivery receipt presented by the delivery person. In the event of damage, non-conforming delivery, failure to unpack, or defective products, the customer can refer to the page "Returns Management". The delivery does not include the commissioning of the devices.

The delivery time does not include weekends and holidays. The order will only be processed upon receipt of payment. The availability and shipment times start from the date of registration and validation of the payment method.

An additional delay is generally to be expected for shipments outside Belgium. In the event of a foreseeable extension of the delivery time, Bohomi will inform the customer as soon as possible and by any means so that the customer can choose whether to maintain or cancel the order in whole or in part. The delay in delivery can in no case result in the payment of damages to the customer or to the customer's service providers.

Withdrawal and right of return

The buyers, non-professional individuals, have a withdrawal period of 14 days from the delivery of their order to return the product to the seller for exchange or refund without penalty.

All items can be exchanged or refunded within the legal time limit, except for products customized by Bohomi according to the customer's wishes, products out of the range (specially ordered), returns of software, CDs, DVDs whose sealed packaging has been opened, books and items that cannot be returned for reasons of hygiene such as headphones, headsets and earphones.

The customer is responsible for the return shipping costs. The customer must contact the customer service before sending the product.

Returned products must be in their original packaging, in perfect condition, accompanied by all accessories and instructions and the return form, duly completed. Items returned incomplete, damaged, or used cannot be taken back, and will be returned at the customer's expense.

Refunds for products will be made within 7 days after receipt of the products by Bohomi. Refunds will be made exclusively by bank transfer or directly to the debit cards.


Transport /Loss

In case of confirmed declaration of loss of the package by our carrier, depending on the nature of the product, available stocks and according to the customer's wish, we will propose to reship the product initially ordered or an exchange product with equivalent characteristics.

In the event of a defect upon receipt, the customer will make a reservation on the delivery form, have the delivery person co-sign and keep a copy of the document. If the product is damaged, the customer must refuse the package and note a reservation on the delivery slip. These reservations must be very precise. The mention "subject to unpacking" does not constitute a reservation and has NO LEGAL VALUE. It is then essential to describe precisely the state of the packaging and/or the product, and to indicate precisely the damage (for example: noises of breakage, opened package, damaged package, torn, pressed on the lower right corner, scratched product, pressed on the left side, package refused because opened or damaged during the delivery...)

In case of impossibility of delivery by the transport provider (for example: failure to keep a delivery appointment, non withdrawal of the parcel after notice of passage or inaccurate address), the customer will have to pay the delivery charges corresponding to the reshipment of his order.


Contractual warranty

The actions based on the legal guarantee of conformity and the guarantee against defects and latent defects are prescribed by two years as from the delivery of the sold good. In the event of a lack of conformity or hidden defects, the return costs are to be borne by the seller.

This warranty offered by Bohomi does not cover :

  • the replacement of consumables,
  • accessories, cases and covers, except in special cases
  • Abnormal or improper use of the products. In this regard, we invite you to carefully consult the instructions provided with the products
  • damage caused by the intervention of a repairer not approved by Bohomi
  • Damage resulting from an external cause (e.g. accident, shock, fire, temperature and/or water variations)

Items will first be sent or dropped off at Bohomi. The acceptance of a repair or replacement depends on the discretion of the manufacturer.



The seller, in the process of selling online, is only bound by an obligation of means; his responsibility cannot be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems.

Bohomi cannot be held responsible for the non-fulfilment of the contract concluded, due to the occurrence of an event of force majeure and in particular in case of total or partial strike of the postal services, carriers, and disasters caused by floods or fires. With regard to products purchased to satisfy professional needs, Bohomi will not be held responsible for any indirect damage, operating loss, loss of profit, damage or expenses that may occur as a result of the present contract.

The choice and the purchase of a product or a service are under the sole responsibility of the customer. The total or partial impossibility to use the products, in particular because of incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the responsibility of Bohomi, except in the case of a proven hidden defect, non-conformity, defect or exercise of the right of withdrawal.


Intellectual property

All elements of the Bohomi website are and remain the exclusive intellectual property of Bohomi. No one is allowed to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio. Any simple link or hypertext link is strictly forbidden without the written consent of Bohomi.


The respect of the private life

In accordance with the law relating to data processing, the files and freedoms, the information with personal character relating to the purchasers could be the subject of an automated treatment. The information transmitted by the customer remains confidential. Bohomi undertakes not to transmit to third parties the personal information that the internet users provide on its website. This information is confidential. Furthermore, users have the right to access and rectify their personal data.


Archiving - Proof

Bohomi will archive the order forms and invoices on a reliable and durable medium constituting a true copy. The computerized records of Bohomi will be considered by the parties as proof of communications, orders, payments and transactions between the parties.


Intra-community or Export purchase

Conditions for VAT-free payment

If you, as a company, provide Bohomi with a valid intra-community VAT number issued by the EU country in which your company is established, Bohomi will not charge you VAT on the amount of your order. We verify your VAT number and identity and invoice in the company name linked to this VAT number.

You must read and accept the following conditions:

  • You represent and warrant that the VAT number you provide to Bohomi corresponds to your company and that this company is established in a country of the European Union;
  • you represent and warrant that all transactions on your account will be made by your company with the VAT number you have provided to Bohomi;

Bohomi will cancel the order in case the VAT number provided is not valid or in case the supporting documents for the exemption are not provided.

Outside the Shengen area, the purchase(s) will be made without VAT. The customs charges or various taxes will be at your charge.

Settlement of disputes

The present conditions of sale on line are subjected to the Belgian law. In case of dispute, only the court of Mons is competent.
